Welcome to Finest City Plumbers (the "Service"), operated by Radical Red Rocket, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, finestcityplumbers.com (the "Website"), and the services provided therein, including our lead purchasing platform at finestcityplumbers.com/buy-lead. By accessing or using the Website or our lead purchasing platform, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Our Service

Finest City Plumbers connects individuals and businesses seeking plumbing services ("Users" or "you") with reputable, vetted plumbing companies in San Diego County. We facilitate this connection by collecting your project details and contact information through our chatbot and sharing it with a select number of plumbing companies who purchase access to your lead. We do not perform plumbing work ourselves, nor do we guarantee the performance of the plumbing companies.

2. User Obligations

When using the Service, you agree to:

• Provide accurate, complete, and truthful information through the chatbot, including your zip code, name, contact details, and project description.
• Use the Service in good faith and refrain from submitting false, misleading, or spam submissions.
• Follow the chatbot prompts to ensure proper submission of your request.

Failure to comply with these obligations may result in termination of your access to the Service at our discretion.

3. No Liability for Plumbing Services

We act solely as a lead generation service connecting you with plumbing companies. We vet these companies for reputability, but we are not responsible for:

• The quality, timeliness, or outcome of any plumbing work performed.
• Delays in receiving quotes or services from plumbing companies.
• Any disputes, damages, or issues arising between you and the plumbing companies.

Once your information is shared with plumbing companies, any subsequent interactions or agreements are solely between you and those companies.

4. Data Use and Privacy

By submitting your information through the chatbot and confirming your request (e.g., selecting "Yes!" to request quotes), you consent to the following:

• We will share your contact information (name, email, phone number) and project details only with the number of plumbing companies you specify (e.g., 3) who purchase access to your lead.
• We securely store your information on Amazon Web Services (AWS) servers.
• We may use your email and phone number to create lookalike audiences for advertising purposes to promote our Service.

5. Free Service for Users

Our Service is provided to you, the User seeking plumbing help, at no cost. Plumbing companies pay us to access the leads we generate. We reserve the right to modify this model in the future, with notice provided through updates to these Terms.

6. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, if we believe you have violated these Terms or for any other reason at our sole discretion.

7. Limitation of Liability

To the fullest extent permitted by law, Radical Red Rocket, LLC, its affiliates, and its operators shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Your use of the Service.
• The actions or inactions of plumbing companies you connect with through the Service.
• Any errors, delays, or interruptions in the Service.

Our total liability to you, if any, shall not exceed $0.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of such courts.

9. Dispute Resolution

Any issues or disputes arising after we connect you with plumbing companies must be resolved directly with those companies. We are not a party to such disputes and will not mediate or intervene.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Website. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

12. Terms for Plumbing Companies

This section applies to plumbing companies ("Plumbing Companies" or "you") participating in our invite-only lead purchasing program via finestcityplumbers.com/buy-lead.

• Eligibility: Plumbing Companies must be vetted and approved by Radical Red Rocket, LLC to receive lead alerts and participate in the program. There is no cost to receive lead alerts, and you may unsubscribe at any time.
• Lead Access: You may purchase access to a lead’s contact information through the chatbot at finestcityplumbers.com/buy-lead if the lead remains available. Leads are provided on a first-come, first-served basis. Purchased leads are for your exclusive use and may not be resold, shared, or transferred.
• Obligations: You agree to: (a) pay the agreed fee for each lead purchased, with no refunds issued after payment; (b) refrain from reselling or sharing lead information; and (c) respond to purchased leads within 15 minutes of receiving contact details.
• Responsibility: You are solely responsible for your interactions with Users, the quality of your services, and compliance with applicable laws. We are not liable for disputes, damages, or issues arising from your use of lead information or failure to follow up.
• Termination: Our lead program is invite-only. We reserve the right to remove you from the program or suspend your access at our sole discretion, with or without cause, including for violation of these Terms or failure to meet program standards.
